4. Legal Bases for Processing
If you are located in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction that requires a legal basis for processing, we rely on one or more of the following: performance of a contract with you; compliance with a legal obligation; our legitimate interests in operating, improving, securing, and marketing our business; and your consent. Where we rely on consent, you may withdraw it at any time, although withdrawal will not affect processing that occurred before withdrawal.
5. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients:
Commerce and technology providers, including Shopify and providers that support website hosting, store functions, point-of-sale systems, customer accounts, payments, fraud prevention, and security.
Operational providers, including payment processors, warehouses, shipping carriers such as FedEx, returns platforms such as Loop Returns, shipping-protection providers, and customer-service providers.
Marketing and communications providers, including Klaviyo, Attentive, email and SMS providers, analytics providers, and advertising platforms.
AI and chatbot providers, including Chatbox AI and the AI model, hosting, analytics, and infrastructure providers that support the chat service.
Professional advisers, including lawyers, accountants, auditors, insurers, consultants, and other advisers.
Government authorities or other parties when required by law, court order, legal process, or when reasonably necessary to protect rights, safety, property, or the integrity of our Services.
A buyer, investor, lender, successor, or other relevant party in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.
We do not share mobile telephone numbers or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. We may share this information with service providers that help us operate our messaging program, such as platform providers and telecommunications carriers.
6. Targeted Advertising, Sale, and Sharing
We do not sell personal information for monetary payment. However, some U.S. privacy laws define "sale," "sharing," or "targeted advertising" broadly. Our use of certain advertising, analytics, and social-media technologies may be considered a sale or sharing of personal information or processing for targeted advertising under those laws.
Where required, you may opt out by selecting the "Your Privacy Choices" link in our website footer, adjusting Cookie Preferences, or using a browser that sends a legally recognized opt-out preference signal, such as Global Privacy Control. We will process qualifying signals as required by applicable law.
7. Cookies and Similar Technologies
What Cookies Are
Cookies are small text files stored on your browser or device. We also use pixels, tags, local storage, software development kits, and similar technologies. These technologies help our website function, remember choices, understand how visitors use the site, measure marketing, and provide relevant content or advertising.
Categories of Cookies We Use
Strictly Necessary Cookies.
These technologies are required for core website functions such as security, fraud prevention, network management, account login, cart functionality, checkout, payment processing, currency or market selection, and saving privacy choices. Because they are necessary to provide requested services, they generally cannot be disabled through our cookie preference tool.
Functional and Personalization Cookies.
These technologies remember choices and help provide enhanced features, including language, location, currency, product preferences, recently viewed products, chat functions, and personalized website content. Disabling them may affect certain site features.
Analytics and Performance Cookies.
These technologies help us understand website traffic, visitor behavior, page performance, conversion, and technical issues. Providers may include Shopify Analytics and, where enabled, Google Analytics or other analytics services. We use this information to improve our website and Services.
Advertising and Targeting Cookies.
These technologies help measure campaigns, limit repeated advertisements, build audiences, and show advertising that may be more relevant to your interests. Where enabled, providers may include Meta, Google, Pinterest, Shopify, and other advertising partners. These technologies may track activity across websites or services and may constitute sale, sharing, or targeted advertising under certain laws.
Marketing and Communications Technologies.
Providers such as Klaviyo and Attentive may use cookies, pixels, or similar technologies to remember sign-up status, understand product and website engagement, personalize communications, and measure email or SMS campaign performance.
Cookie Providers
The technologies used on our website may be operated by Carolina K or by third parties, including Shopify, our payment and security providers, Klaviyo, Attentive, Chatbox AI, analytics providers, advertising platforms, and installed Shopify applications. Not every provider or technology is active for every visitor or at all times. The providers used may change as we update our website and services.
Your Cookie Choices
Where required by law, we do not use non-essential cookies or similar technologies unless you consent. You may accept, reject, or manage non-essential cookies through the cookie banner and the "Cookie Preferences" link in our website footer. You may change your choices at any time. Withdrawing consent does not affect processing that occurred before withdrawal.
You can also manage cookies through your browser settings. Blocking all cookies may prevent certain necessary website features, such as account login, shopping cart, market selection, or checkout, from working correctly. Browser controls may not affect technologies that do not rely on traditional cookies, so we recommend also using our Cookie Preferences tool.
Some cookies expire when you close your browser, while others remain for a set period or until deleted. Retention varies according to the purpose of the technology and the provider's settings. Current details should be made available through the Cookie Preferences tool or the applicable provider's privacy documentation.
8. Email and SMS Marketing
With your consent where required, we may send promotional emails and text messages about products, collections, events, offers, and other Carolina K news. You may unsubscribe from marketing emails by using the unsubscribe link in any promotional email. You may opt out of marketing text messages by replying STOP or following the instructions in the message. Message and data rates may apply.
Opting out of marketing does not prevent us from sending non-promotional communications, such as order confirmations, shipping updates, return information, security notices, or responses to customer-service requests.
9. Artificial Intelligence and Chat Services
We use an AI-powered chatbot, Chatbox AI, to assist with product questions, recommendations, sizing information, order inquiries, and general customer support. When you use the chatbot, you are interacting with an automated AI system, not directly with a human representative.
The chatbot may process the messages and information you submit, including your name, email address, order number, order details, product interests, and feedback, together with relevant technical and usage information. This information may be transmitted to and processed by Chatbox AI and its AI model, hosting, analytics, or infrastructure providers. Chat conversations may be reviewed by authorized team members and service providers.
Chat conversations and the information they contain may be used by us or our providers to operate, evaluate, test, train, or improve AI systems and related automated services. Where required by applicable law, we will request consent before using personal information for AI training or improvement. If you do not want to use an AI service, contact us directly at info@carolinak.com.
Please do not submit passwords, complete payment-card numbers, government identification numbers, health information, or other sensitive personal information through the chatbot. AI-generated responses may be incomplete, inaccurate, or out of date and do not replace official product descriptions, policies, or information provided by a member of our team. The chatbot does not make decisions that produce legal or similarly significant effects concerning customers.
10. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including providing the Services, maintaining transaction and tax records, resolving disputes, preventing fraud, enforcing agreements, and complying with legal obligations. Retention periods depend on the type of information, the purpose for which it was collected, the sensitivity of the information, legal requirements, and operational needs.
For example, order and transaction records may be retained for tax, accounting, fraud-prevention, and legal purposes; account information may be retained while an account remains active and for a reasonable period afterward; marketing information is retained until you unsubscribe or we no longer need it, subject to maintaining a suppression record; and customer-service and chatbot records are retained for support, quality, security, training, or legal purposes according to our settings and provider agreements. We may retain aggregated or de-identified information for longer where it cannot reasonably identify you.
11. International Data Transfers
Carolina K is based in the United States. We and our service providers may process personal information in the United States and other countries, which may have different data-protection laws than your country of residence. Where required, we use appropriate safeguards for international transfers, such as contractual protections or other legally recognized transfer mechanisms.
12. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, transmission, or storage system can be guaranteed to be completely secure. You are responsible for protecting your account credentials and for notifying us if you believe your account or personal information has been compromised.
13. Children's Privacy
Our Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, please contact us so we can take appropriate action. Where a higher minimum age applies under local law, we will follow that requirement.
14. Your Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to request access to personal information; request correction or deletion; obtain a portable copy; restrict or object to certain processing; withdraw consent; opt out of sale, sharing, or targeted advertising; limit certain uses of sensitive personal information; and appeal a decision concerning a privacy request. You may also have the right not to receive discriminatory treatment for exercising a privacy right.
To submit a request, email info@carolinak.com or contact us using the information below. Please describe your request and provide enough information for us to verify your identity and locate relevant records. We may request additional verification and may deny a request where permitted by law. An authorized agent may submit a request where allowed, but we may require proof of authorization and identity verification.
You may opt out of qualifying sale, sharing, or targeted advertising through the "Your Privacy Choices" link in our website footer or by using a legally recognized browser signal such as Global Privacy Control.
15. Third-Party Websites and Services
Our Services may contain links to third-party websites, social-media platforms, payment services, or other services that we do not control. Their privacy practices are governed by their own policies. We encourage you to review those policies before providing personal information.
16. Changes to This Policy
We may update this Policy periodically to reflect changes in our practices, technologies, services, or legal obligations. We will post the revised Policy on this page and update the "Last Updated" date. Where required, we will provide additional notice or request consent before material changes take effect.
